Does Kentucky Have a Small Claims Court for Dental Malpractice?

Small Claims Court - Noakes Law Group

Yes, Kentucky has a small claims court. It operates as a division of the District Court and handles claims up to $2,500. Small claims court offers a quick, informal, and inexpensive way to resolve monetary disputes without hiring an attorney.

But here is what many people do not realize: Small claims court is only appropriate for certain types of dental disputes. Understanding the difference could save you from filing in the wrong court or missing out on significantly more compensation.

What Small Claims Court Can Handle

Small claims court in Kentucky is designed for straightforward money disputes. When it comes to dental issues, this typically includes:

  • Refund disputes for services you paid for but never received
  • Billing errors or overcharges
  • Deposits that were not returned
  • Disputes over the cost of work that was clearly not completed

For example, if you paid $1,500 for dental implants and the dentist closed their practice before completing the work, small claims court could be the right place to recover that money. You are not claiming the dentist injured you; you are simply asking for your money back for services not rendered.

What Small Claims Court Cannot Handle

Here is the critical distinction: Small claims court is not the place for dental malpractice claims.

Dental malpractice involves a dentist’s negligence that causes you actual harm. This includes situations like nerve damage from an extraction, infections from unsanitary conditions, injuries from improper procedures, or misdiagnosis that led to worsening conditions.

These cases involve much more than getting your money back. They involve compensation for medical bills, pain and suffering, lost wages, and future treatment costs. The damages in malpractice cases often far exceed the $2,500 small claims limit, and they require expert testimony to prove the dentist violated the standard of care.

If a dentist’s negligence caused you physical harm, you need a personal injury attorney, not small claims court.

How Kentucky Small Claims Court Works

If your dispute is purely financial and under $2,500, here is the basic process:

First, try to resolve the issue directly with the dental office. Send a written demand letter explaining what you are owed and why. Keep a copy for your records.

If that fails, file a Small Claims Complaint at your local District Court Clerk’s Office. The filing fee is minimal. You will need the dentist’s or dental practice’s name and address.

Once filed, the court will issue a summons. You can have it served by certified mail or through the Sheriff’s Office.

Both parties appear in court on the scheduled date. There is no jury; a judge hears both sides and makes a decision. The process is informal, and you do not need a lawyer, though you can bring one if you choose.

Important Limitations to Know

Kentucky small claims court only awards actual damages. You cannot recover punitive damages. The maximum recovery is $2,500, regardless of how much you are actually owed.

You must also file within the statute of limitations. For oral agreements, you have five years. For written contracts, you have fifteen years.

If your claim exceeds $2,500, you will need to file in regular District Court, where the procedures are more formal and having an attorney becomes much more important.

When to Call a Dental Malpractice Attorney

If your situation involves any physical injury, infection, nerve damage, or ongoing health problems caused by dental treatment, do not go to small claims court. You likely have a dental malpractice case worth far more than $2,500.
